Plea Bargains
- The New Jersey Municipal Court system handles nearly 6
million tickets and complaints
each year.
- 99% of the cases are resolved by a plea bargain or guilty
plea.
- The prosecutor and court system cannot handle
6 million
trials and are very interested in disposing of cases by plea
bargaining.
- You should show up neatly dressed and on time.
- Ask
to talk with the prosecutor and generally you will be
offered an amended summons, often with fewer points.
Most of the time this can
be accomplished without an
attorney.
- Attached is a copy of N.J.S.A. 39:4-97.2. It is the most
common plea bargain statute and carries
no points for the
first two offenses.
- With a speeding ticket, the number of points is based upon
the number of miles per hour over the
posted speed limit.
The prosecutor will often reduce the charged rate of
speed to a violation with less points in exchange for a
guilty
plea.
